1. Introduction
These Terms of Sale ("Terms") govern your purchase of digital books, novels, and other digital content ("Content") from the Costa & Associates Books Marketplace. By purchasing Content, you agree to these Terms.
2. Digital Content License
When you purchase Content from us, you get a license, not ownership.
2.1 Personal Use Only
We grant you a non-exclusive, non-transferable license to access, read, and use the Content for your personal, non-commercial use. You may download the Content to your personal devices (readers, tablets, phones, computers).
2.2 Restrictions
You may NOT:
- Sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to the Content to any third party.
- Remove any proprietary notices or labels on the Content.
- Attempt to bypass, modify, defeat, or otherwise circumvent any digital rights management system or file protection used in connection with the Content.
- Use the Content for AI training without explicit written permission.
3. Payments and Delivery
3.1 Payments
All prices are shown in US Dollars (USD). You agree to pay the price displayed at the time of your specific order. We reserve the right to change prices at any time without notice.
3.2 Immediate Delivery
Upon successful payment validation, the Content will be made available for download immediately. An email with the download link will also be sent to the address provided during checkout.
4. Refund Policy
ALL SALES ARE FINAL.
Due to the nature of digital goods (which can be copied immediately upon download), we generally do not offer refunds once the download link has been provided.
4.1 Exceptions
Refunds may be considered, at our sole discretion, only in the following cases:
- Defective Files: The file is corrupted and cannot be repaired or replaced by us.
- Duplicate Purchase: You accidentally purchased the exact same title twice within 24 hours.
To request a refund under these exceptions, please contact contact@costa-and-associates.com within 7 days of purchase.
4.2 EU Right of Withdrawal Waiver
If you are a consumer residing in the European Union, you acknowledge that by purchasing digital content for immediate download, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal from the contract once the download has begun.
5. Copyright & "Social DRM"
Watermarking Notice: To protect our authors' rights, our digital books may contain "Social DRM" or watermarking. This means your order details (such as your name or email) may be visibly or invisibly embedded in the file metadata. This does not affect your reading experience but allows us to trace files if they are illegally distributed.
You agree not to modify or remove these watermarks.
6. Liability
Our total liability for any claim arising from your purchase or use of the Content is limited to the amount you actually paid for the Content. We are not liable for any indirect, incidental, or consequential damages.
